This website, tradekittools.com, is operated by TradeKit Ltd ("TradeKit", "we", "us" or "our"), a company registered in New Zealand. By accessing tradekittools.com or placing an order, you agree to these Terms of Service, together with our Privacy Policy, Refund Policy and Shipping Policy, which form part of these terms.
1. Products and Pricing
All prices are in New Zealand dollars and include GST. Prices may be displayed in your local currency at checkout depending on your location. We may change prices at any time without notice, but price changes will not affect orders already confirmed. Product descriptions, specifications and images are provided in good faith and are intended as a fair representation of our products; images are illustrative and minor variations may occur. We may improve or modify product specifications over time.
2. Orders and Payment
Payment is taken in full at checkout and is processed securely by our payment providers. We do not store your payment card details. An order is not confirmed until payment has been successfully received and we have issued an order confirmation.
We may refuse or cancel an order where we reasonably suspect fraud, where stock is unavailable, or where an order is affected by an obvious pricing, description or listing error. If we cancel a confirmed order for any of these reasons, we will notify you and provide a full refund to your original payment method.
3. Pre-Orders
Some products are sold on a pre-order basis. Payment for pre-order items is taken in full at checkout. Estimated dispatch dates shown on product pages are our best estimate and are not guaranteed; they may change due to manufacturing or freight delays. You may cancel a pre-order at any time before dispatch for a full refund. If the estimated dispatch date for your order changes materially, we will notify you by email and you may choose to keep your order or cancel it for a full refund. Once dispatched, pre-order items are treated like any other order under these terms.
4. Shipping and Delivery
Orders are shipped in accordance with our Shipping Policy. Delivery timeframes are estimates only. We are not responsible for delays caused by carriers, customs authorities, or events outside our reasonable control, including (without limitation) natural disasters, industrial action, manufacturing delays and freight disruption.
5. Risk and Title
Risk in the products passes to you on delivery to the address you supplied at checkout. Title in the products passes to you once payment has been received in full. If a payment is reversed or charged back after delivery, title reverts to TradeKit until payment is restored.
6. Returns, Refunds and Warranty
Returns and refunds are handled in accordance with our Refund Policy. All TradeKit tools are covered by the 12-month TradeKit Warranty described in our Refund Policy, which operates in addition to your statutory rights.
7. Consumer Guarantees
New Zealand consumers. If you acquire products for personal, domestic or household use, nothing in these terms limits or excludes your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
Business customers. If you acquire products for business purposes, you agree that the guarantees in the Consumer Guarantees Act 1993 do not apply, in accordance with section 43 of that Act, and that this exclusion is fair and reasonable. Business customers remain covered by the 12-month TradeKit Warranty.
Australian consumers. If the Australian Consumer Law applies to your purchase, our goods come with guarantees that cannot be excluded, and nothing in these terms limits or excludes those rights.
8. Proper Use
TradeKit products are designed for trade use and must be used in accordance with the supplied instructions, their intended purpose, and applicable safety practices and regulations. We are not liable for damage, loss or injury arising from misuse, modification, or use of products contrary to their instructions or intended purpose, to the extent permitted by law.
9. Promotional Codes and Discounts
Promotional and discount codes are subject to any conditions stated when the code is issued. Only one discount code may be applied per order. We may withdraw, amend or cancel promotional codes at any time. Codes have no cash value and cannot be applied retrospectively to orders already placed.
10. Intellectual Property
All TradeKit content, including the TradeKit name, logo, product designs, product descriptions, images and website content, is owned by or licensed to TradeKit Ltd and may not be reproduced, distributed or used without our prior written permission.
11. Limitation of Liability
Nothing in these terms limits or excludes any rights you have under the Consumer Guarantees Act 1993 or the Australian Consumer Law that cannot lawfully be limited or excluded. Subject to that, and to the maximum extent permitted by law: (a) TradeKit's total liability arising out of or in connection with any product or order is limited to the purchase price of the relevant product; and (b) TradeKit is not liable for any indirect or consequential loss, loss of profits, loss of revenue, business interruption, or loss of opportunity, however arising, whether in contract, tort (including negligence) or otherwise.
12. Changes to These Terms
We may update these terms from time to time. The version published on this website at the time you place an order applies to that order. If any provision of these terms is found to be invalid or unenforceable, the remaining provisions continue in full force.
13. Governing Law
These terms are governed by New Zealand law, and disputes are subject to the non-exclusive jurisdiction of the New Zealand courts. If you are an Australian consumer, nothing in this clause prevents you from relying on the Australian Consumer Law or bringing a claim in your local jurisdiction where you are entitled to do so.
